Terms of Service

These Terms of Service ("Terms") govern your access to and use of Prompture (the "Service"), including our mobile applications and related services. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

1.1. Binding agreement. These Terms are a legally binding agreement between you and Prompture ("Prompture," "we," "us," "our").

1.2. Additional policies. Your use of the Service is also subject to our Privacy Policy. Google Play and the Apple App Store may also impose additional terms for app downloads and purchases.

1.3. Changes. We may update these Terms from time to time. If changes are material, we will provide notice in the app or by other reasonable means. Your continued use after changes take effect means you accept the updated Terms.

2. Definitions

  • "Account" means your Prompture user account.
  • "Credits" means in-app units used to access AI Features.
  • "AI Features" currently means image generation and AI-powered prompt optimization.
  • "User Content" means content you submit or upload (including prompts, text, images, and inputs).
  • "Generated Content" means outputs produced by the Service (including generated images).
  • "Store" means Apple App Store or Google Play, as applicable.
  • "Third-Party Services" means services provided by third parties used by Prompture (including AI model providers).

3. Eligibility

3.1. Age. The Service is intended for users aged 13+. If you are under the age required to consent to services in your country, you may use Prompture only with a parent/guardian's consent and supervision.

3.2. Compliance. You must use the Service in compliance with applicable laws, regulations, and these Terms.

4. Accounts and Security

4.1. Account creation. You may need an Account to use certain features. You agree to provide accurate information and keep it updated.

4.2. Security. You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account.

4.3. Unauthorized use. Notify us immediately if you suspect unauthorized access.

4.4. One person, one account (anti-abuse). We may limit or restrict multiple Accounts used to evade enforcement actions, payment obligations, or negative credit balances.

5. Privacy and Data Handling

5.1. Privacy Policy. Our collection and use of data are described in our Privacy Policy.

5.2. Store requirements. Apps distributed through Google Play must provide a privacy policy link and disclose data practices; we do so via our Privacy Policy and in-app disclosures.

5.3. Payments. We do not store your full payment card details. Purchases are processed by the relevant Store.

6. The Service and How It Works

6.1. Service scope. Prompture is a prompt workspace that helps you write, optimize, manage, and reuse prompts, and generate images using those prompts.

6.2. No video generation (currently). The Service currently supports image generation only.

6.3. Feature changes. We may add, remove, or modify features at any time, including limiting certain features in certain regions or for safety/compliance.

7. Purchases, Subscriptions, and Credits

7.1. Credits use. Credits are used for AI Features (currently image generation and prompt optimization).

7.2. How you obtain Credits. Credits may be obtained via one-time purchases, subscriptions, promotions, or other grants determined by Prompture.

7.3. No cash value; non-transferable. Credits are not legal tender, have no cash value, cannot be redeemed for cash, and may not be transferred or resold.

7.4. No expiration (with account-status exceptions). Credits granted from purchases or subscriptions do not expire while your Account remains active and in good standing. Credits may be removed or become inaccessible if your Account is deleted, suspended, banned, or otherwise restricted under these Terms.

7.5. Store billing; taxes/VAT. Pricing, billing, and applicable taxes/VAT (if any) are handled by the Store, not Prompture.

7.6. Price changes. The Store provides required price-change notices and may require user consent where applicable.

7.7. No trials. We do not currently offer free trials unless expressly stated in the Store listing at the time of purchase.

7.8. Subscription renewal and management. If you purchase a subscription, it may auto-renew unless canceled through your Store account settings.

7.9. Restore purchases. If supported by the Store, you may be able to restore purchases via Store mechanisms (e.g., "Restore Purchases" on iOS). Availability and behavior depend on the Store.

8. Refunds, Chargebacks, and Credit Adjustments

8.1. Store refund process. Refund requests and determinations are handled by the Store under its policies and applicable law. Apple provides refund request flows through its support tools; Google Play has its own refund policies and processes.

8.2. Credit reversal on refund. If a purchase or subscription is refunded (in whole or in part), Prompture will deduct (reverse) the Credits that were granted for the refunded transaction.

8.3. Negative balance. If you used Credits that are later reversed due to a refund, your Credit balance may become negative.

8.4. Blocking while negative. While your balance is negative, Prompture may block access to AI Features until your balance is brought back to zero or above (for example, via additional purchases or subscription credit grants).

8.5. Fraud and chargeback enforcement. If we detect chargeback abuse, refund abuse, stolen payment methods, or other purchase-related fraud, we may (a) suspend or terminate your Account, (b) revoke Credits, (c) block access to AI Features, and/or (d) restrict future purchases.

8.6. Mistakes and disputes. If you believe a credit reversal or enforcement action was a mistake, contact support and provide relevant Store order details.

9. User Content, Uploaded Images, and Permissions

9.1. Your responsibility. You are solely responsible for your User Content, including any uploaded images and text prompts.

9.2. Rights you must have. You represent and warrant that you own or have the necessary rights, permissions, and consents to submit User Content and to allow Prompture and Third-Party Services to process it to provide the Service.

9.3. Sensitive content and consent. Do not upload images of other people without appropriate consent, especially if the content is sensitive, private, or could cause harm.

9.4. License to operate the Service. You grant Prompture a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify (for technical purposes such as formatting), and display your User Content solely to provide, maintain, and improve the Service and to enforce these Terms.

9.5. Storage duration. While your Account is active, we may store your User Content and Generated Content indefinitely ("forever for now") to provide cloud sync and retrieval, subject to your deletion requests and legal requirements.

10. Generated Content, AI Outputs, and Accuracy Disclaimer

10.1. AI is probabilistic. Generated Content is produced by machine-learning models and may be inaccurate, misleading, incomplete, or unsuitable for your intended purpose.

10.2. No professional advice. The Service and Generated Content do not constitute medical, legal, financial, or other professional advice. You must independently verify outputs before relying on them.

10.3. No guarantee of uniqueness. Generated Content may be similar to content generated for other users and may not be unique.

10.4. Rights and compliance risk. Generated Content may implicate third-party rights (e.g., copyrights, trademarks, publicity rights). You are responsible for how you use Generated Content and for obtaining any needed permissions.

10.5. Safety filters and refusals. We may refuse or restrict certain prompts or outputs to comply with law, Store policies, or safety standards.

11. Prohibited Uses

You agree not to use the Service to:

  1. violate any law or regulation;
  2. exploit, harm, or attempt to exploit or harm minors;
  3. create, upload, request, or distribute child sexual abuse material (CSAM) or sexual content involving minors (zero tolerance);
  4. generate non-consensual sexual content, sexual extortion, or intimate imagery without consent;
  5. create deceptive deepfakes or impersonation intended to defraud or harm;
  6. promote hate, harassment, threats, or violence;
  7. create malware, phishing, credential theft, or facilitate hacking;
  8. evade payment obligations, exploit refunds, or bypass Credit controls;
  9. scrape, reverse engineer, interfere with, or overload the Service;
  10. infringe intellectual property rights or other rights of others;
  11. use automated means to access the Service without our permission (bots, scripts, etc.).

12. Intellectual Property

12.1. Our IP. Prompture, the app, templates (excluding your User Content), UI/UX, branding, logos, and software are owned by Prompture and protected by applicable laws.

12.2. Limited license. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes consistent with these Terms.

12.3. Restrictions. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except where permitted by law.

13. Copyright and Complaints

13.1. Reporting. If you believe content on the Service infringes your rights, contact support with sufficient detail (your contact info, the work claimed to be infringed, and where it appears).

13.2. Actions. We may remove or restrict content and may suspend repeat offenders.

14. Third-Party Services

14.1. AI providers. Prompture uses Third-Party Services to provide AI Features, including ChatGPT and Gemini. Your inputs may be processed by these providers to generate outputs.

14.2. Third-party terms. Third-Party Services may have their own terms and policies. Prompture is not responsible for third-party outages, errors, or policy changes.

14.3. SDK compliance. We aim to ensure third-party code and services used by the app comply with applicable platform policies regarding user data and disclosures.

15. Availability, Rate Limits, and Maintenance

15.1. As-available. The Service is provided on an "as is" and "as available" basis.

15.2. Downtime. We do not guarantee uninterrupted availability. Maintenance or outages may occur.

15.3. Rate limiting. We may impose usage limits to prevent abuse and protect service reliability.

15.4. Changes. We may change model providers, quality controls, and generation settings over time.

16. Termination, Suspension, and Enforcement

16.1. Your choice. You may stop using the Service at any time.

16.2. Our enforcement rights. We may suspend, restrict, or terminate your Account (and access to Credits and AI Features) if we believe you violated these Terms, engaged in fraud/abuse, or created risk or harm.

16.3. Effect of termination. On termination, your right to use the Service ends. Credit access may be revoked. Refund determinations remain subject to Store policies.

17. Account Deletion and Data Retention

17.1. Deletion request. You may request Account deletion as described in our account deletion process.

17.2. What is deleted. When your Account is deleted, we will delete your personal information and personal data, including your prompts, uploaded images, generated images, and other content linked to you, subject to limited legal/technical constraints.

17.3. What may be retained (de-identified). We may retain certain non-personal records such as financial activity logs, API usage analytics, and engagement signals (likes/shares), but only in a way that is 100% unidentifiable to you (de-identified/anonymized), for accounting, security, fraud prevention, and service improvement.

18. Disclaimers of Warranties

To the maximum extent permitted by law, Prompture disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or Generated Content will be accurate, reliable, or meet your needs.

19. Limitation of Liability

19.1. Indirect damages. To the maximum extent permitted by law, Prompture will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, or data.

19.2. Liability cap. To the maximum extent permitted by law, Prompture's total liability for all claims relating to the Service in any 12-month period will not exceed the greater of: (a) the total amount you paid to Prompture through the Stores for the Service in that 12-month period, or (b) 1,500 TRY.

19.3. Legal rights. Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent permitted.

20. Indemnification

You agree to defend, indemnify, and hold harmless Prompture from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content, (b) your use of Generated Content, (c) your violation of these Terms, or (d) your violation of any rights of another person or entity.

21. App Store Terms (Apple and Google)

21.1. Apple-specific acknowledgements. If you downloaded the app from Apple's App Store:

  • The license to use the app is limited to Apple-branded products you own or control and is subject to Apple's Usage Rules.
  • Apple and Apple's subsidiaries may be third-party beneficiaries of these Terms/EULA-style provisions, with the right to enforce them.

21.2. Google Play. Google Play purchases and subscriptions are subject to Google's refund rules and Play policies, and certain developer actions (such as revoking/refunding subscriptions) may occur through Play mechanisms.

21.3. Store controls. The Store is responsible for billing and may enforce its own policies; Prompture may adjust access and Credits as described above.

22. Governing Law and Disputes

22.1. Governing law. These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules.

22.2. Courts. Unless mandatory consumer-protection rules require otherwise, disputes will be resolved exclusively in the courts of Istanbul (Çağlayan), Türkiye.

22.3. Informal resolution first. Before filing a formal claim, you agree to contact support and allow a reasonable time to try to resolve the issue informally.
